This result is unfair and unfortunate. It punishes Michael Morse again for conduct for which he has already been punished. The PA does not believe the parties ever intended for the Basic Agreement to compel such a harsh result.

This is the right result and a big win for consumers. DBS service is the first real competitor to local cable monopolies. As a result of this action, the last remaining DBS slot will not fall into the hands of the dominant cable companies.

We are very disappointed we have not been able to come to an agreement with KPNX to carry their network. Broadcast networks are given free spectrum by the federal government to provide a service to the community. KPNX is available free, over-the-air, to residents in Phoenix. We don't believe Cable ONE customers in smaller Arizona communities should pay for free television. We have worked successfully with other broadcasters including the local affiliates of ABC, CBS, FOX, WB and UPN to keep their stations. KPNX also rejected our offer of a 60-day contract extension while negotiations continue.

We also continue to invest in our system reliability in the field. For example, we are spending incremental $11 million this year to replace underground cable and make other system improvements to affect reliability. The steps we have taken and continue to take should reduce the number and length of service interruptions on our system.

This new agreement, for the first time, will address all aspects of the manufacturing and overhaul programs and material handling for the two vehicle families by both the Army and General Dynamics. This agreement should ultimately result in the highest quality vehicle, at the lowest price, that builds upon the efficiencies of both parties.

Once the power companies had done their job, they gave us the OK to go in, and we were able to go in an do our job. We are hoping to restore all cable within the next week, and this includes Internet service as well. If you have cable (television), you should have Internet service as well. The best way here for all parties is to have an agreement and I'm hopeful that will happen in the next 24 hours.

We had a long conversation [in April] about what to do, so we changed out every cable connector, all the wiring and every electronic box. We felt we had a good system.
