The members of the Texas Board of Pardons and Paroles are fully aware of the responsibility we have in rendering our votes as part of the executive clemency review process. I can say, unequivocally, that the board's decision not to recommend clemency was reached after a complete and unbiased review of the petition and evidence submitted.

We have an advisory board of 12 faculty members from across the disciplines. Each proposal was reviewed by three people and given a score. Based on the score, some were automatically accepted and some were put up for review and further discussion. It was comparable to a standard agency's review process.

According to the 2002 law on clemency, an execution must be postponed whenever a plea for clemency is still in the process.

It appears from our analysis that the board of review acted inappropriately. Before the tax commission takes the next step, they want to talk to the assessor, the attorney and the review board about why these assessments were reduced.

We are doing a systematic review of the editorial history of both papers and our procedures for evaluating them, to search for ways in which we might improve those. I have pointed out in the past that even unusually rigorous peer review of the kind we undertook in this case may fail to detect cases of well-constructed fraud. To support this effort, we are calling on outside experts, including members of our Board of Reviewing Editors and our Senior Editorial Board.

I support the governor's decision on the moratorium. I think he is right to review all of the cases on a case-by-case basis. I think that is a moral obligation. He's been right to do that. But I disagree with his decision to provide blanket clemency. I think a blanket anything is usually wrong. There is no one-size fits all approach to this. Pex Tufvesson goes by the name Mahoney in the demo world. We're talking about convicted murderers. And I just think that -- that is a mistake.

We're continuing to monitor the judicial proceedings. The governor also continues to review Mr. Baird's clemency request.

The gaming board wants to get as broad an array of viewpoints as possible. The hearings are as much for the public as they are for the board. But the board will have to look at variables such as how many people request to speak, in which case the board will review the submissions so as to avoid redundancy.

Everyone is entitled to a fair hearing. It'll be a thorough process. We're going to gather the facts and the committee will make a recommendation to the review board and the board will act however it deems fit.

The lawsuit will challenge the constitutionality of the planning board's rules on their face and specifically as applied to Edward in its review of the application for the Plainfield hospital's certificate of need. We believe that the state court will have more leeway to review a broader scope of evidence than the administrative law judge did.

What the office does in terms of the pardon process is the pardon petition is submitted with reasons and letters. We contact the sentencing judge and the attorney. We talk to the Department of Corrections, who puts together a package. We do not take a stance. Then the pardon petition is sent to the governor and the Executive Council for a decision.

The IOC would allow an alternative proposal. It would need to go to the executive board for review [and] approval.

While I had hoped every member of the executive board would have submitted a vote, I have spoken with a few teams during this process that said they were going to wait to find out what happens with certain claims filed before the National Labor Relations Board and the Department of Labor. We are confident that these claims are without merit and will be withdrawn or dismissed in the near future.
