It's unheard of. It's the absolute right of any American to have a jury trial. You should know that if you exercise that right and go to court you don't have to pay for it.

We're pleased that the court concluded that they had no jurisdiction to overturn the trial judge's ruling. We look forward to going to trial where the jury will have all of the evidence.

We have always believed that the longer this jury deliberates, the greater the chance of no verdict. We also believe that if this trial ends in a hung jury, there will not be a third trial. Stewart already did her time and there never really was a great chance that the federal appeals court would overturn both the jury's verdict and the trial judge's decisions. So this sews up this case on another losing note for Stewart.
