If it were only the federal government's lawsuit, it would be clear that the Appeals Court loses jurisdiction, ... The existence of the state suit makes it significantly less clear. But if the Supreme Court wants both suits, there is little doubt in my mind that it could take both of them.

We are used to ministers or ministries ignoring court verdicts, but for the head of the Constitutional Court and judges to disrespect court rulings is very serious and unprecedented.

I certainly think it helps and probably means that Mr. Rutherford won't be executed Tuesday. Before we can go to federal court we really need to exhaust our state-court remedies.
