The central hope I have for this case in terms of separation of powers is that the Supreme Court will restore the constitutional directive that no one branch of government has the power to accuse, appoint the prosecutor, designate the judges, and render judgment.

It caused consternation (among the judges) that the City Council was looking at it, and they want a separation of powers, ... They're the judicial branch, and they don't seem to think the executive branch or the legislative branch of city government should be looking at them.

I suggest that a provision expressly state that the commission will not interfere in any way in the judicial activity of the...tribunal and that it will provide to the tribunal all the public or confidential information and documents it requires.

What distinguishes the rule of law from the dictatorship of a shifting Supreme Court majority is the absolutely indispensable requirement that judicial opinions be grounded in consistently applied principle.

We must use a judicial, rather than a political, standard to evaluate Judge Roberts' fitness for the Supreme Court. That standard must be based on the fundamental principle that judges interpret and apply but do not make law.

He needs to cite the precedents of the Yugoslavia tribunal, the Rwanda tribunal, the Special Court for Sierra Leone, and domestic courts, which indicate that his response to the situation is perfectly consistent with international due process and fair trial standards.

It's a victory for the government in a narrow sense, because their strategy was to keep the Supreme Court out. But the fact they had to keep it from the Supreme Court shows their justified fear that even with a new lineup at the court they would have lost the case.

The board cannot be expected to surrender its authority to another branch of government; there is a fundamental issue of separation of powers here.

Governor Rell will not move forward with a nomination for chief justice until she is satisfied that all questions regarding the conduct of individual Supreme Court justices have been answered and all concerns addressed. She expects that these answers will come through the Judiciary Committee, the Judicial Review Board and the Supreme Court itself.

We're ready for court. We want a trial. We've wanted to get in court for too long. There's only been one side of this being presented in any tribunal.
