The role of a practicing attorney is to achieve a desirable result for the client in the particular case at hand. But a judge can't think that way. A judge can't have any agenda, a judge can't have any preferred outcome in any particular case and a judge certainly doesn't have a client.

The heaviest sentence imposed on anyone to date for a torture-related death while in US custody is five months -- the same sentence that you might receive in the US for stealing a bicycle. In this case, the five-month sentence was for assaulting a 22-year-old taxi-driver who was hooded and chained to a ceiling while being kicked and beaten until he died.

The government will dismiss the remaining counts of the Miami indictment at the time of sentencing and will also recommend that the sentence imposed in the Miami case run concurrently to any sentence imposed as a result of charges filed today in the District of Columbia.

We had obviously hoped the judge would accept our agreement with the government. Dr. Fisk is disappointed the judge didn't adopt that recommendation. On the other hand, he appreciates the fact that the court said a sentence within the guideline range was inappropriate.

I vote for President Mubarak because I could not find any candidate more handsome than Hosni Mubarak.

It's premature to claim victory at the trial level. We believe the case has gone well for us, and everybody is conscious of an appeal in any case - both parties as well as the judge.

There are judges at all levels who may face a situation where there is a potential conflict of interest, either a situation where an attorney presenting a case before them has given a large sum of money or where the judge, as a candidate, has made statements implying favor or bias for one side of a case over the other. Many judges will remove themselves from a case if a conflict is apparent, but there are no official standards. A conflict that one judge might step aside for, another judge might not see as a problem. Rather than a standard set of guidelines for everyone to use it really is, forgive the pun, a judgment call.

We're not saying that Judge Perkins is a bad judge or an unfair judge. What we are saying is this is the wrong case for him to judge.

Any such challenge had to be registered on January 21 when the prosecution received notice the case had been assigned for trial to Judge Arnason. The affidavit filed on January 22 was thus a day too late. The people's challenge must be rejected as untimely,

Irving had expected certain strictness by the court because he was a very well known case. But the sentence was too harsh. It became a bit of a (political) message trial and the message was too strong.

I don't believe he ever lost the courteousness and the willingness to try a good case but at same time be understanding. I believe John will make an excellent judge because not only does he have the knowledge of law but he knows you have to be patient particularly in criminal district court. We know that this case, no matter how it's decided by Judge Fogel, is going to be appealed to the 9th Circuit and probably to the U.S. Supreme Court, so it's very important for us to get the case done right.
