[The judge] basically denied us our right to a jury trial. This was a decision made by a judge in chambers. They said he did it; we say he didn't. A jury should be able to make that decision.

The judge instructs the jury to judge the case on the basis of the law. A jury swears on an oath to uphold the law. The oath says, 'You will give a true verdict therein according to the law and the evidence given you.' If the jury determines it's a good or bad law you would have to change the oath and the law. No one would know what would be enforced in each courtroom.

It's been a very successful Act I. This trial is being run by a skilled and experienced judge. Given what can go wrong in a trial, nothing has gone wrong. The trains are running on time. From a prosecution standpoint, you need the trains to run on time. The moment a jury begins to not understand things, they become suspicious and resentful.

We have always believed that the longer this jury deliberates, the greater the chance of no verdict. We also believe that if this trial ends in a hung jury, there will not be a third trial. All of this would be especially positive for Tenet, as they would be able to start recruiting doctors more aggressively and volumes at the company may improve. Maybe -- just maybe -- it is getting closer to this outcome.

The reality is, this judge has signaled his feelings already and NTP won a jury trial already. Under the normal operation of patent cases, they are entitled to an injunction unless there are extraordinary circumstances.

Our laws are clear that the length of pre-trial detention may not exceed 30 days, but some of these people have been detained for months or years without trial. Nearly half of them are found innocent when they finally do come to trial.

If we went to trial and the jury believed the plaintiff, I am sure the award would be in seven figures. I don't think the jury would believe that, but you never know what a jury is going to do.

I don't mince words. I speak bluntly, and I'll continue to do that. Remember, this is coming from a company that, in the last (New Jersey) trial, engaged in a shouting match with the judge. I promise I won't do any of that. We just need to be nice and polite - to the court, to the jury, to each other.

The jury is still out on whether or not the service providers will end up using it for video distribution. If they do, I would see that happening more outside the US because both in Europe and Asia they don't have as much coax in homes as we do.

Too much money has been spent on both sides and my feeling is that the company can get a fair trial given the diverse amount of people in Houston.
