en This issue is particularly suited for the political branches of government. This is an issue of tremendous international political importance. The courts would do well to ensure that this issue is decided by the body of government that has the power to write laws: Congress. Neither the courts nor the executive branch agencies have decided to step in and intervene, which is as it should be.

en There's no question that this decision will embolden the school choice opponents to throw the uniformity argument against the wall and see if it sticks in other states. But Wisconsin has already resolved the issue the other way. I would feel comfortable going into any court and reading both decisions - I have no doubt the courts would pick the Wisconsin decision.

en No one has signed on to his view that the benefits are illegal. He has been authorized to make that argument in his own name but not on behalf of the City Council or the City of San Diego, ... I would never have voted to authorize him to litigate this illegality issue if the retirement board hadn't brought it up.
