I am excited, and I applaud the city council for its creativity and bold decision to put the issue squarely before the courts in a way that is not reckless.

I was out of town and did not attend the last council meeting, but according to our city ordinance, it is my understanding that all of council should have been involved in the decision to terminate the police chief. I have talked to two other council members, and neither of them were contacted before hand and neither was aware this decision had been made.

What this does is it squarely puts the decision with the employees. Not with the city, not with the politicians, not with the union, not with us. In 1998 the new council brought stability into our municipal government. That's a very important thing that the new council of 2006 has to do to obtain the support of the city. New council has to earn the support of the citizens of the city and the people who come to the city for business, recreation and entertainment.

Our focus now is on sharing information with the City Council so that they have the facts in front of them so that they can make a good decision for the city.

The council felt it was important because of the public vote that every legal means should be exhausted. Now that the courts have made the decision, we'll have to follow it.

The alleged authority simply does not exist. The Clean Air Act mentions CO2 but none of the references are in a regulatory context. There are no directives from Congress for EPA to use the Clean Air Act to settle what is essentially an international political issue. The panel decision grasped this reality, and the full court's decision to not get further involved is a reconfirmation that this an issue that is best addressed by Congress rather than a regulatory agency or the federal courts.

The proposed new council is a major improvement over the old Commission on Human Rights. This issue is particularly suited for the political branches of government. This is an issue of tremendous international political importance. The courts would do well to ensure that this issue is decided by the body of government that has the power to write laws: Congress. Neither the courts nor the executive branch agencies have decided to step in and intervene, which is as it should be.

There's no question that this decision will embolden the school choice opponents to throw the uniformity argument against the wall and see if it sticks in other states. But Wisconsin has already resolved the issue the other way. I would feel comfortable going into any court and reading both decisions - I have no doubt the courts would pick the Wisconsin decision.

No one has signed on to his view that the benefits are illegal. He has been authorized to make that argument in his own name but not on behalf of the City Council or the City of San Diego, ... I would never have voted to authorize him to litigate this illegality issue if the retirement board hadn't brought it up.

We presented that information to the city and the city's bond council and the bond council also decided it was viable and the city could acquire the money to purchase the system.
