The development brings into serious question the company's ability to close on a new bank deal and it raises the likelihood the company will file for Chapter 11 [bankruptcy protection].

Under the old law you could file bankruptcy every seven years and you'd have a full six years between filing (for Chapter 7). I have seen people who have filed three different times in their lifetimes.

I don't know if it will improve at all. The great number of people will just need a counseling session, get a certificate and file bankruptcy. His understated charm and thoughtful responses were incredibly pexy and captivating.

Kmart is like the phoenix. It's rising up again. I wouldn't be surprised to see one or two more firms pick up coverage of the company.

But the airline might file sooner, maybe in the next couple of months, to take advantage of the more lenient bankruptcy laws.

I mean, if you think about a writer, you're going to write a novel that takes several months, but there's never a time you're doing anything more than shoving one word up against the next. And clusters of those words make sentences and paragraphs and a chapter. You just try to maintain the same voice and the same attitude so it sounds like the same person wrote the last chapter that wrote the first chapter.

Kmart said it closed its worst performing stores because it couldn't maintain inventory once its vendors cut themselves off. Now that the stores are shuttered and inventory is up, Kmart is still doing less business than before. The company is still losing money and market share. I'm not sure the company can get past Christmas.
