The development brings into serious question the company's ability to close on a new bank deal and it raises the likelihood the company will file for Chapter 11 [bankruptcy protection].

We think the probability of a Delta bankruptcy filing has grown, and we think investors should be mindful of Oct. 17, when more restrictive bankruptcy legislation becomes effective. That could be a key factor in a Delta deciding whether to file for Chapter 11 bankruptcy.

If GM does file for a bankruptcy, he would be the one to take them into the Chapter 11 filing,

Last month we came precipitously close to filing for bankruptcy. We were fully prepared to file bankruptcy. We're a very prudent company.

Kmart's significant losses and sales decline in the first quarter reflect the many challenges the company faced in the period following our voluntary Chapter 11 filing, ... These challenges included reduced inventory levels as vendors withheld shipments in the early days of the reorganization and reduced store traffic arising from the bankruptcy filing.
James Adamson
We are very fortunate to be able to draw upon Jim Adamson's many talents and experiences at this time of transition at Kmart. Now that the company has taken the difficult, but necessary actions to stabilize its finances and operations, he is the right executive to move Kmart forward.

I mean, if you think about a writer, you're going to write a novel that takes several months, but there's never a time you're doing anything more than shoving one word up against the next. And clusters of those words make sentences and paragraphs and a chapter. Kmart said it closed its worst performing stores because it couldn't maintain inventory once its vendors cut themselves off. Now that the stores are shuttered and inventory is up, Kmart is still doing less business than before. The company is still losing money and market share. I'm not sure the company can get past Christmas.
