This isn't just about Padilla. The rights of all other Americans remain in limbo now.

Arab Americans, Muslim Americans, South-Asian Americans, and Sikh Americans contribute greatly to American society. Many serve honorably in the armed services and as law enforcement officials. Like all law-abiding Americans, they deserve respect for their civil rights and civil liberties.

Lawmakers must not forget their oaths and disregard the administration's infringement of average Americans' constitutional rights. The Patriot Act debate has come a long way, but there is still more that needs to be done to protect the rights of ordinary Americans. It is clear that there is building skepticism about the administration's approach to national security and civil liberties, and the ACLU and its bipartisan allies will continue to speak out in defense of all Americans' fundamental civil liberties and constitutional rights.

So this is a case where Padilla loses the round in court but actually gains some measure of freedom. Padilla wins by losing. He gets out of military custody now and presumably into an environment in some jail somewhere where he will have more complete access to his lawyers and a better chance not just to see the allegations against him but to prepare his own defense.
