Much of what the government has attached to its sentencing memo is disputed by the defense. It is the government's effort to obtain through sentencing what it didn't obtain through the guilty plea. We intend to file something in response next week. We believe that the court will give fair consideration to our arguments at sentencing.

The problem for Cunningham at sentencing is that he can't really argue that his many years of public service warrant leniency since the charges against him, and what he pleaded guilty to, go to the very core of the quality and integrity of that service. Character witnesses are for when you're guilty and are looking for lenient sentencing.

There's no requirement for the accused to explain why he pleaded guilty. He may do so at sentencing.

Sentencing is prolonged to exercise some leverage over the defendants. I don't think the defendants are in any great hurry either. If they testify, the chances of the government coming to bat for them later on for a reduction in sentence is greatly enhanced.

If the government cannot explain what happened at Enron and why it was wrong in terms a jury of 12 lay persons can understand, then the government will likely fail to obtain convictions. All the defense has to do is put on a sincere expert, or several sincere experts, that the jury likes. The government always has the burden of proof, and confusion and lack of clarity will only aid the defense.
