All you have to do is declare bankruptcy and you can run away from your contract, so the retirees expect the leaders will have to do something to avoid G.M. declaring bankruptcy.

This is a day we hoped would never come. However, we are prepared for this event. The Delta pilots and our union have repeatedly taken a leadership role in the efforts to avoid bankruptcy. Unfortunately, Delta's plan to avoid bankruptcy was not successful. Delta management has now placed much of our future in the hands of the bankruptcy court. We will use all legal means to protect our contract.

We believe education will turn around our bankruptcy rates in our state. At present, the group most declaring bankruptcy is the 26-to-35-year-old demographic. But, the 18-to-25-year-old group is fast overtaking that group, and that alarms us. We hope that this course, which will be taken by (high school) juniors or seniors, will raise their understanding so they can avoid pitfalls that will send them or their spouse into a serious financial situation.

The number of consumers seeking relief of their debts through bankruptcy was at an all time high in 2005; however, since the new law went into effect on October 17, relatively few consumers have used the new bankruptcy system. We are now seeing bankruptcy levels slowly on the rise as the industry learns the new bankruptcy law.

The bankruptcy issue will not recur and should actually benefit us going forward as we expect a reduced level of bankruptcy filings under the new law. We fully expect trading to do better in the coming quarters.

The impact of the change in bankruptcy laws and changes in our practices for overdraft charge-offs and over-limit credit card fees reduced pretax results by about $320 million. People wait until the last minute to go to the bankruptcy lawyer's office because they don't want to be in the bankruptcy lawyer's office. We're hoping that people recognize that bankruptcy is still an option for them, and that if their home is at stake, that they need to get in earlier to get it done.

The objective is to head (bankruptcy) off if you can possibly avoid it. (Dana) will try to avoid it.
