Bush may make serious attempts at reforming the tax code and social security; he's much less concerned with the risk of failure than previous presidents have been. The expected need to replace two or three Supreme Court justices, however, could so poison the water in Washington that very little will get done. (That is, unless he nominates Professor Tyson, who would be a model jurist).

Governor Rell will not move forward with a nomination for chief justice until she is satisfied that all questions regarding the conduct of individual Supreme Court justices have been answered and all concerns addressed. She expects that these answers will come through the Judiciary Committee, the Judicial Review Board and the Supreme Court itself.

The Court could decide the Bush appeal is moot. The Court is always concerned about overstepping its bounds, and the Justices could decide that in the period since they agreed to hear the case, the facts have changed such that the case is no longer alive.

John Kerry said today that he stands by ... his claim that certain foreign leaders have told him that they hope he wins. And George Bush fired back. He said oh yeah, certain Supreme Court justices have told me that I'm going to win.
