If HIPAA is to be truly protective and useful, healthcare entities and their executives must be held accountable in the same way that Sarbanes-Oxley holds CEOs and CFOs responsible.

Essentially what I see happening is everyone involved in the appointment and selection of senior executives is now much more aware. Sarbanes-Oxley [the federal financial reporting law] is putting a much greater onus on the board. Ethics becomes very important in the hiring process ... If they end up hiring a CEO to the extent of 'an Enron,' the board will be held responsible, too.

The problem with Sarbanes-Oxley is that it means 20 different things to 10 different people. There's a tremendous wealth of folklore that has been built up around it in the IT sector. A lot of people are trying to push us into spending money on Sarbanes-Oxley compliance, but I trust our auditors.

Companies and government agencies must contend with a number of industry-specific email retention laws and regulations, such as the Sarbanes-Oxley Act, HIPAA and SEC Rule 17a-4, which means a system that works for one may not work for others. We want to give our customers a number of options to choose from, rather than forcing one bundled solution on all of them.

That's what presidents do, they identify who is and who isn't. We hold our players responsible and accountable and I'm being held accountable, too.

Isn't that what it is all about, accountability? Those who break our immigration laws should be held accountable. Those who hire illegal aliens should be held accountable. And those who turn the other way and claim there is no problem should be held accountable.

Compliance mandates like Sarbanes-Oxley have thrown a wrench into many email security strategies. It's fine to wipe out worms and viruses. But that's not enough. If your email system leaks confidential financial information, or if you can't retrieve old emails when regulators knock on your door, your executives can wind up in legal trouble.

With a recent University of Rochester study concluding that the total effect of Sarbanes-Oxley has reduced the stock value of American companies by a staggering $1.4 trillion dollars, it is now clear that the costly regulatory burdens imposed by this legislation absolutely outweigh its benefits. The PCAOB and the Sarbanes-Oxley Act raise unconstitutional barriers to needed liquidity, discourage entrepreneurship and innovation, and hinder U.S. competitiveness by denying access to needed capital. Further, the high cost of compliance that disproportionately affects smaller public companies is having long-term, exponential negative implications for our economy.

The civil justice system holds negligent corporations and CEOs accountable when they endanger the public's health and safety to increase corporate profits. It's no wonder they'll use phony studies to attack it.

That's pretty much all related to Sarbanes-Oxley.

Somebody has to be held accountable. We need to find out who was responsible for the mess over there.

I'm not blaming anyone in particular, but whoever in the government is responsible for this has to be held accountable.
