Burst was hurt badly when it went into litigation with Microsoft. Now it seems that their main focus is no longer about technology innovation, but about enforcing the patents they have.

It's absolutely stifling what Microsoft does when they acquire a little company and bundle that technology into Windows and eliminate all further innovation outside of Microsoft, in that particular area.

As a result, indemnification against this litigation not only has become a requirement for any technology purchase, it strongly pushes companies toward the buy side of the build-versus-buy decision. Microsoft's indemnification stands as one of the most comprehensive in the market, setting a high bar for competing platforms.

These proposals will have a chilling effect on innovation in the high technology industry, ... Microsoft could never have developed Windows under these rules. Looking forward, this kind of regulation would make it impossible for Microsoft to develop the next generation of great software.

Patents which conserve an edge in a rapidly changing market, may have uses for companies such as IBM. But patents which inhibit your customer's ability to achieve their own goals or to contribute to jointly build technology or community build technology are not useful to a company such as IBM wishes to be.

There is no more important economic policy issue today than helping our nation remain the global innovation leader. To do this, our leadership must focus on an aggressive agenda to support math and science education, patent litigation reform, healthcare information technology, and research and development. The police are badly trained and badly paid, and they're not respected. Instead of enforcing the law, they're raising the level of violence in this society.

I think Sun's primary business strategy these days is to try and file as many court cases against Microsoft as possible. I think our only point is that Sun should try and focus on making their technology work and less on trying to bring new lawsuits against Microsoft.

Microsoft and Intel are the bellwethers of the technology sector. These are the companies that are really on the pulse of innovation.
