My first death penalty victory--made on behalf of the single most offensive legal argument I've ever made. There was no doubt in my mind, in the minds of my colleagues in the public defenders' office or in the minds of ... the Florida Supreme Court that domestic homicide cases tended to be treated very differently from stranger killings.

In some cases, this may actually make the difference. It has an impact on those people who aren't rigidly in favor of the death penalty, but who could still change their minds.

Initial open court sessions of death penalty cases during their second verdict in some provinces and municipalities have proved to be successful. The Supreme People's Court is confident to spread it nationwide. It is important to open up the dialogue and debate this issue given the pronouncement by the Supreme Court justices coupled with his (Lee's) desire to ensure that the death penalty remains a policy in Florida.

[In the midst of an undeclared war on terrorism, the courts could ultimately establish new legal precedent.] There are issues we have never dealt with before, ... And some of it has to be made up as we go along. It may be why the Supreme Court is not eager to circumvent the ongoing process. Of course there are implications, for the death penalty and death row inmates in all states, when the Supreme Court of the land hears such a case.

So I've made the decision as a United States senator to try to find some legal assistance and I'm going to take this to court. It is now time for the Supreme Court, if this continues and we don't break this filibuster, to give us their view of what is going on here.
